Marina Flood Damage
Two days before Christmas 2022, a winter storm caused Hampton Bay canals to experience a catastrophic overflow. The resulting canal flood caused significant damage to a fixed-dock marina and its MEP systems. AAG was retained by the insured to navigate a unique Property Damage and Nautical Specialty Equipment claim and to evaluate
and coordinate the repair of the damage.
Emergent Concerns
-
The storm that caused damage occurred just weeks after a highly destructive Category 4 Hurricane, Ida, creating uncertainty in the policy applications from the insurance company adjuster.
-
The marina sustained damage to the Mechanical, Electrical, and Plumbing systems, including fuel pumps and lines, lighting, and ship-to-shore power systems.
-
The dock was originally built with pressure-treated lumber and, when damaged, required specialty disposal due to toxicity.
-
The fuel was also contaminated and required an environmental remediation company to remove it.
-
Owners had concerns about the timeline as their summer season opened in late March, and the threat of losing the season would have been financially catastrophic.
Solutions
-
AAG meticulously reviewed the policy to support an updated replacement value of the structure that addressed all applicable specifications and associated costs.
-
AAG assembled a team that included an environmental remediation company, permit expeditor, debris removal services, dock specialty contractors, and engineers to prepare and support a claim submission to the carrier.
-
A meteorologist was consulted to determine that the storm was not a hurricane by assessing its wind speed, atmospheric pressure, and other characteristics, ensuring that policyholders receive appropriate coverage for their losses.
Recovery
-
Within 90 days, AAG put the marina on the critical path to repair and expedited the town permitting and rebuilding of the dock -allowing the marina to reopen in time for the summer season.
-
AAG negotiated with the property's insurance company and achieved a multimillion settlement.
